Because of the influence of the Hague Conference on Private International Law, however, the reference is now more commonly to the law of a person’s “habitual residence” (as it is in the law of jurisdiction). Private international law refers to that part of the law that is administered between private citizens of different countries or is concerned with the definition, regulation, and enforcement of rights in situations where both the person in whom the right inheres and the person upon whom the obligation rests are private citizens of different nations. Private international law has two limbs. It determines when an English court has jurisdiction to adjudicate where one or more of the parties, or some component of the analysis, is not English, and it decides whether to give effect to the result of adjudication in a foreign jurisdiction: this amounts to the conflict of jurisdictions.
